List of diseases preventing arrest in Kyrgyzstan approved

A list of serious illnesses preventing keeping of the suspects and the accused in custody was approved in Kyrgyzstan. The Prime Minister of Kyrgyzstan Mukhammedkaly Abylgaziev signed a relevant decree.

The press service of the Cabinet noted that the decision was made to bring subordinate legislation in line with the requirements of the new edition of the Criminal Procedure Code of the Kyrgyz Republic.

The list was worked out by an interdepartmental working group, which included the representatives of particular specialties of the Ministry of Health and the State Service for Punishment Execution.

Patients with chronic and protracted mental disorders with severe persistent or often exacerbated morbid manifestations (chronic psychosis and dementia), which prevent the ill person from realizing the actual nature and social danger of their actions or directing them, are also not recommended to be kept in custody.

In addition, the list includes the diseases of the nervous system and sensory organs, blood circulation, respiration, digestion, musculoskeletal systems and connective tissue.

Kidney diseases with chronic renal failure at the terminal stage are also an obstacle to detention.

The resolution will come into force on January 1, 2019.
