Families of fallen servicemen to be able to privatize housing for free
The Ministry of Defense of Kyrgyzstan proposes to allow the families of servicemen, who died in the line of duty, to privatize apartments in state and departmental housing stocks free of charge. The draft resolution has been submitted for public discussion.
The current variant of the document states that «the state apartments provided to officers and warrant officers, who were transferred to the reserve or retired due to age, health reasons, due to layoffs, family and other important circumstances and who have served for 20 years or more, are transferred to their personal ownership free of charge».
But, as the authors of the document point out, the rights of the families of servicemen who died in the line of duty are not protected. This is due to the fact that, according to the Housing Code, the privatization of service apartments is allowed through direct sale.
It is proposed to include a clause that allows the families of the fallen soldiers and officers to receive state property in their own possession without redeeming it from the state.
Privatization of official residential premises is allowed in exceptional cases by direct sale to the property only of disabled war veterans and those who have become incapacitated due to injury, concussion received in the defense of the USSR and the Kyrgyz Republic or in the performance of other duties of military service, or due to illness associated with being at the front; participants of the Great Patriotic War, who were the members of the active army, and families of servicemen and partisans who died or went missing in the defense of the USSR.
