Kyrgyzstanis with expunged criminal record not to be able to work as notaries

President of Kyrgyzstan Sadyr Japarov signed the Law «On Amendments to the Law of the Kyrgyz Republic «On Notaries». The press service of the head of state reported.

The document was adopted by the Parliament on April 25, 2024. The goal is to introduce humanization in the issuance and revocation of licenses for the right to engage in private notarial activities.

The following changes are made to the Law «On Notaries»:

1) Clause 5 of Part 8 of Article 4 is set out in a new wording, according to which a person who has previously committed an intentional crime, regardless of whether his or her conviction has been expunged, or in respect of whom criminal prosecution for grave and especially grave crimes has been terminated on non-rehabilitative grounds, cannot be a notary of the Kyrgyz Republic;

2) Amendments are made to paragraphs 4-7 of part 1 of Article 17, according to which a license is suspended by the Ministry of Justice, including in the following cases:

  • Failure to notify the Ministry of Justice within 30 days of changes in information required for inclusion in the State Register of Private Notaries — up to one month;
  • Violation by a private notary of the procedure for performing notarial acts or other regulatory legal acts regulating notarial activities, based on the results of an audit of the notary’s activities — for the period of undergoing additional training to improve their qualification in the manner established by the Chamber of Notaries;
  • Violation of the Code of Professional Ethics of a private notary on the proposal of the Chamber of Notaries — up to one month;
  • Delivery of archival documents in paper and electronic form (digitized) to the notary archive in violation of the deadline of up to 30 calendar days — up to one month.

3) Clause 2 of part 3 of Article 18 is set out in a new wording, according to which a license is revoked, including on the grounds of the presence of a decision to terminate a criminal case and/or criminal prosecution against a person who previously committed a deliberate crime, regardless of whether it was terminated or his or her criminal record has been expunged, or in respect of whom criminal prosecution for grave and especially grave crimes has been terminated on non-rehabilitative grounds.

4) The first sentence of part 2 of Article 29 should be stated in a new wording, according to which the amount of payment for services for the preparation of draft documents and other services of private notaries is determined by the methodology for determining the amount of payment for notarial services, approved by the Ministry of Justice in agreement with the Chamber of Notaries.
